Summary of the House Committee Version of the Bill

HCS SB 416 -- ADVERSE POSSESSION OF CERTAIN LANDS

SPONSOR:  Goodman (Pratt)

COMMITTEE ACTION:  Voted "do pass" by the Special Committee on
Utilities by a vote of 10 to 0.

This substitute prohibits the use of adverse possession to
acquire lands belonging to rural electric cooperatives and
nonprofit corporations which provide electrical service under
Section 394.200, RSMo.

If all parties to a boundary dispute over water service areas
agree to settle, the requirement that the Missouri Public Service
Commission hold hearings regarding the dispute is waived.  The
commission retains power to hold hearings regarding territorial
disputes under Sections 247.172 and 394.321.

FISCAL NOTE:  No impact on state funds in FY 2008, FY 2009, and
FY 2010.

PROPONENTS:  Supporters say that the bill extends the same
protection to nonprofit corporations and rural electric
cooperatives that public utilities currently have.

Testifying for the bill was Senator Goodman.

OPPONENTS:  There was no opposition voiced to the committee.
